Casa Pagoda online shop Terms & Conditions (T&Cs)
1.1. Language. The binding version of these terms is the English one. The Thai version only serves the convenience of the user. In these Terms and Conditions "we" and "us" mean Casa Pagoda and "you" means you - the Customer. These Terms and Conditions together with your Order constitute the entire Contract between Casa Pagoda and you for the supply of Products.
1.2. Casa Pagoda online shop www.casapagoda.com sells furniture and accessories. The products are only being sold within Thailand. For special deliveries please contact us by mail to see how we can help.
1.3. The product offerings are directed to both Consumers and Business Customers, as end users.
2.1. Purchases on www.casapagoda.com are only accessible to registered members. The registration and the membership are free of charge. They do not involve an obligation to buy. Casa Pagoda may refuse an invitation or a registration without giving any reason.
3. Placing your order
3.1. You place an Order by adding items to `My Cart’ on Casa Pagoda Web Site and clicking the "Check Out" button. When you place your Order, we will issue you with an Order Number. By placing an Order, you make an offer to us to purchase the Products you have selected based on these Terms and Conditions.
3.2. Casa Pagoda will send you order confirmation and delivery information by e-mail within 48 hours.
3.3. Information contained on the Casa Pagoda website constitutes an invitation to buy, but it is not an offer by us to supply any Products. We will, however, make every effort to supply Products to you. Once we arranged delivery, we will send you an Order Confirmation via email. We do not formally accept your offer until your order has passed our internal validation procedures for the purpose of preventing credit card or payment fraud.
3.4. Casa Pagoda and its affiliates reserve the right to refuse service. In the unlikely event that we cannot process or accept your Order after payment is received, we will contact you by email.
4.1. Only credits are offered if you have changed your mind about the product, made an incorrect choice, or failed to verify and accurately provide information when placing an Order. You may be entitled to a credit, provided you return the item to us within 14 days of your order being dispatched. The item must be returned to us in brand new condition, with the packaging and item being exactly as it was when you received it. Return postage is at your expense. We will issue you a Credit Voucher to the value of the item, once the item is returned.
4.2. All products should be returned to the following address: Casa Pagoda, 4 Sukhumvit 45, Klongton Nua, Wattana Bangkok.
4.3. Our two-week return policy does not apply to items ordered to your specifications e.g. custom-made, pre-ordered furniture.
5. Prices and shipping costs
5.1. When placing an order, the price quoted on the article page at the time of the order is the valid one. It will be confirmed also by the email.
5.2. Shipping costs within Thailand are included in the quoted price.
5.3. All Casa Pagoda purchase price includes VAT unless otherwise stated on the Product listing.
5.4. When an order is placed using a discount code and it contains a number of items, the value of the discount is spread over each item according to the pro-rated value of that item.
6. Payment methods and processing
6.1. Purchase value has to be settled immediately after the conclusion of the contract.
6.2. Payments are being settled by use of credit cards.
6.3. Transactions are processed via an industry standard secure https connection using Kasikorn bank K-payment as a payment gateway. This means that you can be assured that your sensitive data such as credit card numbers will remain confidential because all information is 128bit encrypted. The server we connect to is authenticated through PKI certificates issued by a root Certificate Authority.
7.1. We will deliver your Products to the address indicated on your Order Confirmation.
7.2. You will receive the information about shipment details via an email. Casa Pagoda will do its best to ship the goods within two weeks after the confirmation of the sales order. However, dependent on the type of product and the producer, the goods may be shipped later.
7.3. The Customer takes the responsibility that the ordered goods can be delivered at the indicated delivery address within normal working hours. We will have to charge you extra for the unsuccessful tries to deliver.
7.4. Damages incurred during shipping should be reported immediately to the carrier and Casa Pagoda. This has no effect on the warranty, but may facilitate any claims Casa Pagoda may bear against the carrier. We will refund any items damaged in transit, at our cost, just as soon as we receive the damaged item back. We apologize for any inconvenience. It would also be very helpful if you were able to include some digital pictures of the damage so we may be able to assess it and process your replacement quicker.
7.5. If your Product has not arrived within 7 days, please contact us.
7.6. Title and risk of loss to all Products will pass to you on delivery.
7.7. All shipments are fully insured by Casa Pagoda. If you have received an item that is damaged please contact us via the contact us page and advise us of the nature and extent of the damage. Please also advise us of your name, contact number and order number.
8. Force Majeure
8.1. Casa Pagoda shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of Casa Pagoda, and Casa Pagoda shall be entitled to a reasonable extension of time for the performance of such obligations.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Thailand and shall be subject to the non-exclusive jurisdiction of the courts of Thailand.
